This site is operated by Smoky Product Company, LLC d/b/a Grow Funky Beans. Throughout the site, the terms “Grow Funky Beans,” “we,” “us,” and “our” refer to Smoky Product Company, LLC d/b/a Grow Funky Beans.

By visiting our site and/or purchasing something from us, you engage in our Service and agree to be bound by the following terms and conditions (“Terms of Service” or “Terms”), including any additional terms, conditions, and policies referenced herein or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers, merchants, and contributors of content.

Please read these Terms of Service carefully before accessing or using our site. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all of the Terms, then you may not access the website or use any services.

Any new features or tools added to the current store shall also be subject to these Terms of Service. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on WordPress, which provides the website platform we use to sell our products and services.

 

Online Store Terms
By agreeing to these Terms of Service, you confirm that you are at least 21 years of age and have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

General Conditions
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

 

Accuracy, Completeness & Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any  and all reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

Modifications to the Services & Prices
Prices for our products are subject to change without notice at any given point in time. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

Products or Services
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy and Guarantees. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer at any point in time. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Order Processing
All credit and/or debit card payment processing is done in real-time accordance with your banking institution. Charges on your statements will say Grow Funky Beans.

Shipping
Seeds will be shipped the next business day after payment has been authorized. Standard shipping within the continental US can take 1-5 business days but is not guaranteed.

Returns & Replacements
Our promise extends through our community of growers from a place of sincere respect for the product. While we have successfully replicated our approach innumerable times and work tirelessly to source the highest-possible quality seeds, it’s inescapable that planting and growing cannabis is a biological process. And so, not every seed will germinate!

Customers can receive replacement seeds when: (1) you have followed our Grow Guide but both seeds from a 2-count package and/or 5 or more seeds from a 10-count package did not germinate; or, (2) seeds have been damaged during shipping.

To process a return, send picture proof of either the ungerminated seeds and/or damaged packaging to [email protected] within 21 days of receipt. Please try to make the photos as detailed as possible. Our team will review your case and get back to you within two business days. 

If your seeds are eligible for replacement, Grow Funky Beans will ship only the number of replacement seeds for those that did not germinate or were damaged. Seeds that do not germinate due to grower deviation from the Grow Guide, or that are lost/damaged after receiving them, will not be replaced. 

We reserve the right to refuse returns and the right to refuse refunds to avoid exploitation of our policy – although nearly all unopened items returned within 21 days of receipt (that are undamaged on the customer’s part) would qualify.

In instances where there was an error on our part we will always make it right and issue either a full return or credit to ensure the best experience with our company.

Refunds & Exchanges
Unopened seed packages can be exchanged within 21 days of receiving them. Contact [email protected] to initiate an exchange.

If you are returning an item valued over $75, use a trackable shipping method and consider shipping insurance. We can’t guarantee receipt without tracking.

 

FUNKY GROWERS REWARDS

Funky Growers Rewards is our customer rewards program for Grow Funky Beans. Members earn CannaCredits from eligible purchases and can redeem those credits for savings on future orders.

The program is simple: buy seeds, earn CannaCredits, use those CannaCredits for discounts later.

Enrollment
Customers may join Funky Growers Rewards by creating an account or completing an eligible purchase while logged into their account.

Participation in the program requires a customer account so earned CannaCredits can be tracked and applied to future purchases.

Rewards Points System
CannaCredits are earned through eligible purchases on growfunkybeans.com.

Customers earn:

1 CannaCredit for every $1.00 spent on eligible purchases.

CannaCredits have a redemption value of:

10 CannaCredits = $1.00 in store credit.

For example:

• 10 CannaCredits = $1.00 off
• 50 CannaCredits = $5.00 off
• 100 CannaCredits = $10.00 off

CannaCredits are based on the eligible order subtotal after discounts and before taxes, shipping, or other fees unless otherwise stated.

CannaCredit Availability
CannaCredits earned from purchases may be held until the order is completed, shipped, or otherwise verified.

If an order is canceled, refunded, declined, reversed, or determined to be fraudulent, any CannaCredits earned from that order may be removed from the customer’s account.

CannaCredit Redemption
CannaCredits may be redeemed during checkout when a customer is logged into their account.

Customers must have at least 100 CannaCredits before redeeming rewards.

CannaCredits may be used a little at a time or all at once, subject to checkout limitations, product restrictions, and availability.

CannaCredits have no cash value and cannot be exchanged for cash, transferred to another customer, or applied retroactively to past orders.

Excluded Rewards
Funky Growers Rewards no longer offers CannaCredits for birthdays, anniversaries, social sharing, reviews, referrals, quizzes, email signup, SMS signup, Secret Stash enrollment, Autoship enrollment, or order-count achievements.

Rewards are now based on eligible purchases only.

CannaCredit Expiration
CannaCredits may expire if not used within the time period stated on the rewards page or in the customer’s account.

Grow Funky Beans may update, pause, or end the rewards program at any time. Any changes will apply according to the current rewards terms posted on the website.

CannaCredit Adjustments
We want the rewards program to stay fair and clean.

Customers may keep CannaCredits earned from orders that are exchanged, unless the exchange changes the qualifying order value. Refunded purchases may result in the removal or adjustment of CannaCredits earned from that purchase.

Grow Funky Beans reserves the right to adjust, remove, or cancel CannaCredits if rewards are issued by mistake, abused, earned through fraudulent activity, or used in a way that violates these Terms.

Wholesale Partnerships
In order to become an Authorized Wholesale Partner, you must have a valid reseller’s license and submit a Wholesale Partner Application. Please ensure that you correctly fill out all of the required fields in order for our team to respond in 2-3 days.

All Authorized Wholesale Partners receive:

• 50% off SRP with an MOQ of $500 per order

• First-time wholesale orders receive an additional 10% off

Payment is due in full at checkout for all wholesale orders purchased online. The minimum order requirement to apply the 50% off SRP wholesale discounts is $500 ($1,000 retail value). Accuracy of Billing & Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Optional Tools
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our services (or any part thereof).
